Voting Question: Urgently required answer to the following questions.... under australian common law and equity?

Queensland Biodiesel Pty Ltd (“QBP”) manufactures a range of biomass-based fuel products. It developed its possess equipment for a new product and signed a $65,000 contract with Brisbane Industrial Computing Services Pty Ltd ("BICS") to supply a computer system to operate that specialised equipment. During negotiations, BICS expressly assured Queensland Biodiesel that its computer system was technically sophisticated, reliable, and could easily meet and exceed QBP's very exacting performance specifications. However, the written contract made no mention of those performance guarantees. It did, however, have an exclusion clause as follows: BICS shall not be liable to Queensland Biodiesel for any loss or damage that occurs as a result of the failure of its computer system to operate any equipment not also supplied by BICS below this agreement. When Queensland Biodiesel asked about the effect of this clause prior to signing the agreement, BICS said that it was a standard clause designed to exclude liability for needy performance caused by incompatible equipment supplied by its competitors – not its clients – and that it would not apply to QBP. However, the computer system failed disastrously. It failed to regulate the production process as required, causing equipment damage totally $250,000. Repairs took a month, causing a $500,000 loss in production output that QBP had contracted to sell, for marketing promotion purposes, at $400,000 – an estimated one-off net loss of $100,000. As a result, buyers cancelled their purchase contracts for non-timely delivery. In addition: • QBP had to import a more costly ($85,000) control system in order to minimise lost production time; • QBP lost a $125,000 Queensland Government grant due to the month's delay in delivery of the first batch of its new product (it was relying on this payment to offset its first sale at a loss); and • The production delay and additional costs led to a re-evaluation by the Moreton Bank of QBP's risk profile, increasing bank charges by $25,000. Required: With reference to Australian common law and equity (not the sale of goods or other legislation) advise Queensland Biodiesel Pty Ltd as follows. (A) Is BICS' assurance about its computer system's performance qualities a mere representation or an actual term, express or implied, of the contract the parties later agreed to in writing? (5 marks) (B) In the circumstances described, is BICS able to rely on the exclusion clause? (10 marks) (C) What would be the effect of a whole of agreement clause: that the written contract was the entire agreement between the parties, on the status of the word-of-mouth assurance? (5 marks) (D) In the event there is (i) a whole of agreement clause but (ii) no contractual clause or stipulation specifying what the computer control system is to do, has there been a breach of the contract allowing Queensland Biodiesel the option of terminating the contract? (10 marks) (E) If the contract does not contain either (i) a whole of agreement clause or (ii) an exclusion clause then what (if any) damages in contract would BICS be liable to Queensland Biodiesel for, resulting from the failure of its computer control system as supplied?

Resolved Question: Is there a way to find out if a logistics company is phony?

A company sent me an email stating that they received my CV (resume). It seemed a little shady to me because they stated that packages would arrive to my home (jewelry, electronics etc...)I would boat them overseas. Almost sounds like a Nigerian scam. I went online to look if company was legit. Even though they have a website, it still feels shady. The company is based out of India. Why have items arrive out of my home when they can set up a tiny office? I will attach most of the letter. Some misspellings in the letter; another red flag, but since American English is not their native writing style, as is the queen's English, should I overlook it? Maybe I should check with the FBI? Resolved Question: Do conservatives realize Karl Marx supported/created the idea of Supply-Side Economics?

Cause I can only think that the reason why they use "Marxist" as an insult is because they dont realize this? - Interestingly, the most famous proponent of this approach was Karl Marx, who maintained that the owner-capitalist class propels industrial development by re-investing profits in plants and equipment, thus building up society’s capital stock and the means of production. SSE is, in that respect, an entirely Marxist theory. (excerpt from following article from the Institute for ethics and emerging technologies) http://ieet.org/index.php/IEET/more/brin20100220 Just seems awfully hypocritical to me, also SSE is a terrible idea(much like many of marx's theories are).

Resolved Question: Honestly, why is it so hard to believe that we are causing global warming?

We are seeing it around us every day, yet people still deny it! It scares me that so many people let the politicians discredit scientists. The same thing happened in Russia, and they are still decades behind us in science. Here are some common objections I hear: The earth is warming naturally: Yes, climates do change naturally. However, the concentration of greenhouse gases has increased to unprecedented levels directly coinciding with the industrial revolution (the beginning of our exploitation of fossil fuels for energy). It's not happening, because there is still snow/it still gets icy in the winter: Don't confuse climate with weather. They are two different things. Climate change means a change in precipitation and temperature patterns, not necessarily that it will never receive icy again. Are we not already seeing that? There were no instruments back then, so you can't know what the concentration of gases was: Actually, we have many proxy records that are quite accurate. As glaciers formed for thousands of years, they trapped tiny bubbles of atmospheric gas which accurately reflect the concentration of gases at that time. We can also find ancient pollen fossils buried in lake sediments, which show us what the vegetation was like in an area in the distant past. Vegetation reflects climate, and so helps us reconstruct ancient climates. Scientists are just in it for the money: This one is silly to me. First of every, the people who want you to deny it (oil and energy companies) make a thousand times more money that scientists who say it is happening. Secondly, scientists live on relatively modest salaries (when was the last time you saw a scientist on Cribz?). When we receive funding, it is for our study (to buy equipment and process samples), NOT to increase our personal profit. In fact, if we were to misuse funds like that we would never receive funding again! The ClimateGate emails prove it's a scientific conspiracy: The scientists involved have maintained that those emails were taken out of context and were simply an exchange of ideas (not difficult to believe something was taken out of context when someone is trying to PROVE a conspiracy). The incident and every related data was investigated by SIX independent agencies (three from the U.S., three from the UK) who found there was NO evidence of wrongdoing. Also, scientists maintain an extremely ethical community which really allows no room for manipulation of data. I have known of exactly 1 person in my scientific career who falsified data, and he was unceremoniously drummed out. We have to publish our findings in peer-reviewed journals, meaning no fewer than three scientists in your field review your work - they don't know your name and you don't know theirs - before it can be published. This eliminates the chance for falsified information to be published. We are trained to be ethical, it is expected in our line of work, probably more so than any other line of work. Al Gore is just in it for the money: I don't give a crap about Al Gore. He's not a scientist. Maybe he is just in it for the money, but so are the energy companies. It's a moot point. In the 70s they predicted global cooling: In the 70's there was some concern about aerosols contributing particles to the atmosphere. Some scientists suggested this could contribute to global cooling, but there was never a scientific consensus. The problem was compounded by the media's incomplete understanding of atmospheric science, which led to many inaccurate reports. Man is too tiny to affect the entire earth: Well, that is simply not true. You have to think of the earth as a closed chemical system. Remember from chemistry - when you have a closed system with a certain concentration of chemicals, it will behave a certain way. When you introduce new chemicals or more of one chemical into the system, it changes its behavior. It is the same thing with the earth. We are taking carbon (fossil fuels) out of sequestration (below the earth), and burning them and releasing them into the atmosphere. You can't change concentrations like that and expect it to have no effect. There is no scientific consensus: 98% of climate scientists agree that it is happening and man is causing it. If 98% of economists said something about the economy, I guarantee we would follow it! It will kill jobs: The energy companies are worried about THEIR jobs, not YOUR jobs. New tech will provide plenty of jobs. Finally, I just want to say, I'm not a doomsayer nor are the scientists who investigate this. We know the earth will survive, but we are going to have to shift our cultures and our lifestyles to accommodate this new set of circumstances. It's better to do it now than later.

Resolved Question: What jobs are in high demand in the US?

Today's Wall road Journal has an article that says that certain blue collar jobs are in high demand but that people don't have the skills needed, so the jobs go unfilled. They are mechanics (especially heavy-vehicle mechanics), specialists in electrical repairs on commercial and industrial equipment. AAR Corp has openings for skilled trade jobs like welders and maintenance mechanics and would hire a third shift if they could find enough people with the right skills. Union Pacific wants to hire "installation technicians" but is having trouble finding people with the right technical skills from either a 2 year degree or 4 years of experience. And here's another article on the same topic. http://online.wsj.com/article/SB10001424052970203537304577028353961942914.html What other jobs are in high demand?

Resolved Question: I allowed my son to sublet in my workshop for two months. The past two months he has paid no rent, and has?

caused major damage to my equipment, doors, tools, and now states he lives there. He has accumulated piles of filth, refuses to clean, or to keep himself clean. He builds weapons out of my tools and store supplies without consent, and uses intimidation. I have had the police out several times and they state that since my son feels he lives there, they cannot remove him. No landlord-tenant agreement ever existed, I merely set up a cubicle he could use to do computer/office type work only. Do I need to formally evict my son? He routinely commits acts outrageous and extreme and is very threatening and destructive.I live in Oregon and the space is zoned industrial, not residential.

Resolved Question: Government wasting money?

Hi there, I have recently become interested in something call urban exploration. I don't participate in it myself although I like looking on a number websites connected to it. Basically it is about exploring empty/boarded up buildings such as hospitals, schools, theme parks and many industrial sites. Anyway, whilst looking throught the photographs I couldn't help but think what a lot of money is being wasted (I assume) by abandoning buildings for years on end, most of which are in perfectly good condition and many of which are still full of equipment and fittings etc. One that springs to mind is the Royal Manchester Childrens Hospital. It is still full of medical gear and has stood empty since the opening of the new super hospital in June 2009 with (so far as I can find) no prospects of anything being done with it. There are many other buildings in the same position as this and if we are struggling so desperately for money in the U.K. would it not make sense to either "make do and mend" the buildings we currently already have or at least clear them out of their fixtures and perhaps sell them? I may be wrong but I think that lesser developed parts of the world would buy our "outdated" medical equipment. There is also a sports centre somewhere in Essex which was built just over 10years ago which has been let go and vandalised as the lotto funding for the projects based there dried up. Surely a perfectly good structure should be utilised as 2.1million pounds of "our" money was used providing it. There is a swimming pool, squash courts, running tracks and the like. Is it not the year of the Olympics? Surely there is some use for this place. I am tightening my belt to try and keep cash, wonder if the government should perhaps take a look at its assets and do the same? Resolved Question: What's an estimate on how much it could cost me to start my own bakery?

I'll be going to go to culinary school for pastry in 1 1/2 years, and after maybe a year or two working and learning below someone else, but right after that I want to receive my possess place. I'm not planning on building from the ground up, hopefully just renovating an old tiny restaurant or something like that. Of course I have no idea what that would cost, what new (or used if I can) equipment like industrial appliances could cost, the cost of buying ingredients in huge amounts, or what a certified cooking staff should be payed, what my taxes will be on the place. And can accountants help to figure out every these things, or are they really just for managing the business finances once the business is already up and running? I googled cost of starting a bakery and 2 or three results said I needed to have saved up or taken out a loan on at least $500,000, and one site said one million!! That's more than the average cost of buying a home, and I had expected at most somewhere around $100,000 and I'll accept it if its really more like $250,000 but $500,000??? Could I be 70 before I have that paid off?! And of course I have plans to keep up for LIFE e.g. college/trust fund for any kids I might have, retirement. I don't want to receive married and have kids until my bakery is up running and bringing in cash, but if that means taking out a crazy loan when tiny businesses are still on shaky ground as it is... I guess I'll just have to work below someoneone as the best pastry cook ever and just pray they decide to retire really early and give me thier bakery (sarcasm). I really really want to possess my possess bakery, and though my family would like to help, they really don't have the combined funds to give me the money to do this, and it doesn't seem fair to take from them anyway. By bakery I mean, cakes, other breads, specialty coffee and tea, and even some brunch items, and a few places for people to sit down and eat and not a cupcake or doughnut store. I'm only 17, but I really can't stand to do anything without planning ahead of time, though Yes, I know things usually dont go as planned, but still it can't hurt, and Ive known what I wanted for a really long time. What are the real cost, and what am I missing here?

Voting Question: Finance Questions - Cash Flow Analysis?

A wealthy industrial economist dies, and her will specifies that $10 million of her estate will go to University of Waterloo (UW) to fund a tiny engineering economy building as well as 20 graduate scholarships per year over the next 20 years. The scholarships are to have a value of $24,000 (per each scholarship) per year for the first year and this should increase at a rate of $3,000 per year over the following 19 years. UW requires that $30,000, starting with the third year of the bequest, be reserved for building maintenance and operating costs. These costs have to have a linear increase of $4000 per year, starting with year 4. Assuming that 10% interest rate is used for such analyses, determine how much will be available for building first costs (for construction of the building). Suppose that you have an opportunity to invest in a fund that pays 12% interest rate. Today, you invest $10,000 into this fund. Three years later (year 3), you borrow $5,000 from a local bank at 10% interest rate and invest it in the fund. Two years later (year 5), you withdraw enough money from the fund to repay the bank loan and every interest due on it. Three years from this withdrawal (year 8), you start taking $2,000 per year out of the fund for 4 years (year 11). After another year (year 12), you have withdrawn your original $10,000. The amount remaining in the fund is earned interest. How much is the remaining amount? Maintenance on new equipment is expected to cost $1000 in each of the first two years, when it is below warranty, and $5000 in the third year. In each of the following 4 years, the maintenance cost is expected to increase by $2000 over the previous year. The MARR is 15%. Calculate the gift worth, now of the maintenance cost.

Resolved Question: Atlas Toyota Material Handling Career Opportunities?

Me and my pal are both unemployed and my dad is an Industrial Equipment Technician with Atlas Toyota Material Handling. I am curious, because my dad has a career with them and has been there since 1993 would me and my pal who is aquainted with my dad have a better chance to land a career with Atlas rather than someone with little experience that has no relative there? High School Diploma is the only education I have and I have no previous work experience. Also, some upcoming opportunities are Delivery Driver, Forklift Techincian, Parts Customer Care Representative and Dock Clerk. Basically, would I have a better chance to land a career with this business because I have a relative or would someone with experience have more of an opportunity. Also, before this business would post an opportunity online they would talk to each employee which would include my dad and ask if they know someone that is interested in an opportunity before it is posted online, so that is a positive aspect about a career with this business.

I already did one but I'm seriously considering whether I should actually use this one: I found a star-shaped memory box that my sister used to possess and glued a lot of the stuff that was in it to the surface, as well as other odds and ends with personal meaning; the message was going to be about nostalgia. The thing is, I feel like the traditional definition of found art is more in line with using things that are sort of more industrial, practical and/or typical objects, just with a spin on them. I feel uncomfortable with the memory box idea and I'm thinking I want to change it. What do you think? Also, does anyone have any very basic ideas for alternate options? don't elaborate on that too much cuz it's obviously my piece but i'm thinking of using an old shoe or sports equipment or something. can anyone run my inspiration here?? (due this fri.)

Resolved Question: The economy for the trans national corporations couldn't be better. For wage earners, not so hot. Why?

Right after WW2 when labor unions were strong, American corporations made the best stuff in the world AND made huge profits. Taxes were high, but everyday our social and physical infrastructure got better. We built heavy equipment, trucks, cars, washing machines, refrigerators, houses and tall buildings. China built re-education camps. Now the unions are busted, taxes are rock bottom and we don't make anything. We trade our industrial base for 'Everyday Low Prices' that aren't even that low and the Made in China 'stuff' is pure crappola! The GOP/Tea/Fox/Jesus freak party doesn't seem to have a problem with this and they for sure don't want Barack to do anything about it either. Is this the end of the Republic? A massive bloated military that can't defeat two 3rd world countries based on a worn out industrial base and populated by needy people just doesn't seem like the way to go. Evidently there are lots of people who don't really care, or simply don't understand the situation.

Voting Question: can syringomyelia be a work related injury?

I was recently diagnosis with syringohydromyelia and a couple of hernia disk after after I hurt myself while working. I've done some research and arrive to find there are a couple a ways to receive syringohydromyelia. One of them being trauma / post trauma related. If I can determine and have tests prove that I don't have any of the other conditions that cause syringohydromyelia then that would leave only trauma as the cause. I work with industrial equipment that weight between 80-125 lbs. every my past jobs has been in an office setting where there wasn't any heavy lifting involved. I am going to look a neurologist , because of my back, leg and arm pain. My question is can you develop syringohydromyelia by repetitive heavy lifting? Could at some point in time I hurt myself working that caused this syringohydromyelia to develop ?

Voting Question: Is aluminium prices delibrately kept low from fears of metal thievery? like what happened to copper?

Aluminium prices are incredibly low as if it is oppressively done for unrelated reasons like metal thievery . I am sure that you heard news about lowlifers running around stealing copper wiring and pipes right out of equipments and churches.. etc.. I used to suspect that it had a lot to do with industrial heavyweights who want to look metal prices kept low so to maximize profits. Now I am pointing to scrap metal dealers for being willing to pay in cash to anybody that comes with metal scraps ... I think that our government can and should outlaw the use of cash to pay any scrap metal sellers or low lifers.. Either sellers has to be certified or be paid in kinds as long as it is not cash like paying the seller's expenses electronically. That way , low lifers cannot receive any cash and they usually have nothing like accounts that can be credited electronically for thier sales of stolen metal scrap of any nice.. We can still allow low lifers to steal steel and iron as they are to heavy and worth less as well as difficult to rip off anywhere. They can go out in the boonies where there is plenty of old rusty vehicles that they can haul out to sell no question asked, I dont care! Aluminium is supposed to be worth far more today yet it is still fetching a lousy dollar a pound today or 25 cent in 1980 dollars... Aluminium were trading at a dollar in 1980 which means that aluiminum shoudl be $4 by now... What the heck is going on ... is our govenrment asleep at the swtich ? or the trading pits?
